Terms & Conditions

Last updated: 26 September 2026

1. Parties and definitions

These terms apply to use of bactiquick.co.nz and to orders accepted by Taranaki Applied Innovation Centre Limited, NZBN 9429053466464, trading through the Bactiquick New Zealand brand (TAIC, we, us or our). Customer or you means the person or organisation using the website or purchasing products. Products includes the Bactiquick Tester, reagent/test packs, accessories and related materials.

2. Acceptance and authority

By using the website, creating an account or placing an order, you agree to the parts of these terms that apply. If you act for an organisation, you confirm that you have authority to bind it. Checkout acceptance records your agreement to the current terms and linked policies. A quotation, approved trade account or signed agreement may contain additional terms; if inconsistent, the specifically agreed written term prevails for that transaction.

3. Website information

We aim to keep website information accurate and current, but photographs are illustrative and colours, packaging or minor specifications may change. We may correct an obvious error, including a pricing error, and will contact you if it affects an order.

4. Product purpose and use

Bactiquick provides a real-time field indication in about 15 minutes to help frontline teams investigate conditions, prioritise action and decide when further testing is needed. It is an operational endotoxin/Gram-negative bacterial risk indicator; it does not identify individual organisms.

You must use Products only for their intended purpose, follow current instructions, training, storage, expiry and safety information, and ensure operators are competent. Where law, consent conditions, a regulator, an accredited method or your own risk framework requires laboratory testing or confirmation, you remain responsible for arranging it.

5. Accounts and trade approval

Cash customers may be permitted to buy without an approved trade account when an available payment method is used. Trade pricing, credit or payment terms require a B2B account and our approval. We may request business, identity, authority, credit and trade-reference information, set or change a credit limit, or decline or suspend terms.

6. Prices, GST and quotations

Unless expressly stated otherwise, prices are in New Zealand dollars and exclude GST and delivery. GST is added at the applicable rate. Website prices may change before an order is accepted. Approved customer-specific or volume pricing may replace the public price when correctly applied to the account.

7. Orders and contract formation

Your order is an offer to buy. An automated receipt only confirms that we received it. A contract forms when we send written acceptance, issue a non-provisional invoice, or dispatch the Products, whichever occurs first. We may decline or cancel an order before acceptance because of availability, pricing error, credit concerns, suspected fraud, delivery limitations or legal restrictions. If payment has been taken, we will refund the affected amount.

8. Payment

Payment methods available at checkout may include direct bank transfer and, when enabled, card payment through a third-party provider. Use your order number and business name as the bank-transfer reference. Funds must clear before dispatch unless approved written trade terms apply. You must pay an undisputed invoice by its due date.

9. Delivery, title and risk

Delivery is governed by the Shipping, Returns and Refunds Policy. Estimated dispatch and arrival dates are not guarantees. Title passes when we receive full payment. Risk passes on delivery to the address supplied, subject always to rights and remedies that cannot lawfully be excluded. You must ensure delivery details are accurate and that temperature-sensitive deliveries can be received and refrigerated promptly.

10. Inspection and product issues

Inspect deliveries promptly. Tell us as soon as practicable if Products are missing, damaged, warm on arrival, incorrect or apparently faulty, and preserve packaging, labels and photographs. Notice within 48 hours helps us investigate a courier claim but does not remove rights that cannot lawfully be excluded.

11. Returns, refunds and warranty

Returns and refunds are governed by the Shipping, Returns and Refunds Policy. The Bactiquick Tester also carries the separate one-year warranty. That warranty is additional to, and does not replace, any rights under the Consumer Guarantees Act 1993 or other law that cannot be excluded.

12. Consumer Guarantees Act and business purchases

If you acquire Products as a consumer, nothing in these terms limits or excludes rights or remedies under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other law that cannot be excluded.

If you acquire Products in trade, both you and TAIC are in trade, these terms are in writing and it is fair and reasonable that the parties be bound by this clause, the parties agree that the Consumer Guarantees Act 1993 does not apply to the supply. This clause does not contract out of the Fair Trading Act 1986.

13. Liability

Nothing excludes liability that cannot lawfully be excluded, including applicable consumer rights, liability for fraud or wilful misconduct, or liability for personal injury caused by negligence where exclusion is prohibited.

For a customer acquiring Products in trade, and to the maximum extent permitted by law: neither party is liable to the other for indirect or consequential loss, loss of profit, revenue, production, data, goodwill or opportunity; and TAIC total aggregate liability arising from the relevant order or event is limited to the amount paid or payable for the affected Products. This does not apply where a specifically agreed written term states otherwise.

14. Intellectual property

All website content, product names, trademarks, manuals, graphics, software and materials are owned by or licensed to TAIC or the relevant rights holder. You may use supplied manuals and materials internally for proper Product use. You may not copy, modify, reverse engineer, republish or commercially exploit them except as permitted by law or written permission.

15. Acceptable website use

You must not misuse the website, attempt unauthorised access, introduce malicious code, scrape it at unreasonable scale, impersonate another person, submit unlawful or misleading material, or interfere with its operation.

16. Third-party services and links

The website may link to independent services. Their terms and privacy practices apply. We are not responsible for third-party content or availability, but this does not limit responsibility we have under law for providers acting on our behalf.

17. Confidentiality

Each party must protect non-public commercial, technical and account information received from the other and use it only for the relevant relationship. Product results belong to the customer, subject to any agreed support, anonymised analytics or legal requirements.

18. Force majeure

Neither party is liable for delay or failure caused by an event beyond its reasonable control, excluding an obligation to pay money already due. If a material delay continues, either party may cancel the unperformed portion and any prepaid amount for that portion will be refunded.

19. Privacy

Our Privacy Policy applies to personal information. By submitting information about another person, you confirm that you are authorised to do so and have provided any notice required by law.

20. Changes

We may update website-use terms prospectively by publishing a revised version. Terms governing an accepted order will not be changed retrospectively unless required by law or agreed in writing.

21. General

If any provision is invalid or unenforceable, it is modified to the minimum extent necessary or severed without affecting the rest. A failure to enforce a right is not a waiver. You may not assign an accepted order without our written consent.

22. New Zealand law and contact

New Zealand law applies and New Zealand courts have non-exclusive jurisdiction.
